NEW DELHI: The Delhi High Court on Friday granted Varun Gandhi of the Bharatiya Janata Party (BJP) anticipatory bail in a criminal case filed
against him on the directions of the Election Commission over his alleged anti-Muslim speeches.

Justice Reva Khetrapal granted anticipatory bail to Varun Gandhi till March 27 after his lawyers pleaded before the court that the provision for anticipatory bail wasn’t available in Uttar Pradesh. The candidate from Pilibhit, Uttar Pradesh, in the forthcoming Lok Sabha polls was asked to furnish a personal bond of Rs 50,000.

The first information report (FIR) against Varun Gandhi was filed at Barkheda Police Station in Pilibhit under Sections 153 A (promoting enmity between different groups on ground of religion) and 188 (disobedience to order duly promulgated by a public servant) of the Indian Penal Code and Section 125 of the Representation of the People Act.

The grandson of late prime minister Indira Gandhi, Varun Gandhi, who is planning to make his electoral debut this year, has alleged that the FIR, which was lodged nine days after he made the alleged speeches, was a part of a conspiracy to spoil his political career and tarnish his secular image.

In the FIR, Varun Gandhi has been accused of having delivered a communally inflammatory speech on March 8 which has caused insecurity in the minds of one particular community.

The FIR also states that the meeting was held without permission and in violation of Section 144 imposed by the local administration.

Holding that his alleged anti-Muslim speeches amount to violation of the model code of conduct, the Election Commission Wednesday slapped notices on Varun Gandhi and the BJP, seeking their response by Friday and ordered video tracking of his entire campaign. Varun Gandhi replied to the notice Friday.

Allahabad, Mar 19 (PTI) BJP leader Varun Gandhi, against whom a criminal case has been filed on the directive of the Election Commission over his anti-Muslim speeches, today moved the Allahabad High Court seeking quashing of the FIR which, he claimed, was a result of “a political conspiracy”.
In his petition, 29-year-old Varun has challenged the FIR filed on March 17 at Barkheda Police Station under Sections 153 A (promoting enmity between different groups on ground of religion) and 188 (disobedience to order duly promulgated by a public servant) of the Indian Penal Code and Section 125 of the Representation of the People Act.

அவர் பேசியதில் தவறில்லை. அதனால், அவருக்கு பாரதிய ஜனதா கட்சி ஆதரவு தெரிவிக்க வேண்டும். அவரை கைவிடக் கூடாது. நம்நாடு ஜனநாயக நாடு என அழைக்கிறோம். இந்த ஜனநாயகத்திற்கு ஆதரவாகவே வருண் பேசியுள்ளார். அவரின் பேச்சை நிறுத்த முற்பட வேண்டாம். வருண்காந்தி மன்னிப்புக் கேட்க வேண்டிய அவசியமும் இல்லை.

பீலிபட், மார்ச். 18- மேனகா காந்தியின் மகன் வருண் காந்தி உத்தரப்பிரதேசம் மாநிலம் பீலிபட் தொகு தியில் பாரதீய ஜனதா கட்சி வேட்பாளராக நிறுத்தப்பட்டுள்ளார். அங்கு பிரச்சாரத்தில் ஈடுபட்ட அவர் ஆவேச மாக பேசினார். அதில் ஒரு பேச்சு முஸ்லிம்க ளுக்கு எதிராக உள்ள தாக கூறப்பட்டது. அவ ருடைய பேச்சை சி.டி. யாக தொகுத்து எதிர்க் கட்சியினர் வெளியிட்டு உள்ளனர். அதில் இடம் பெற்றுள்ள அவருடைய பேச்சு வருமாறு:- இது எனது கை (தனது கையை உயர்த்திய படி) காங்கிரஸ் கட்சியின் சின்னமான கை அல்ல. இது தாமரையின் சக்தி. இது தலைகளை துண் டிக்கும். ஜெய்ஸ்ரீராம். யாராவது இந்துக்களை நோக்கி விரலை நீட்டி னால், யாராவது இந்துக் கள் பலவீனமானவர்கள் என்று நினைத்தால், கீதை யில் சொன்னபடி அவர் கள் தலையை நான் வெட்டுவேன். இவ்வாறு பேச்சு உள்ளது. அதில் ஒரு இடத்தில் முஸ்லிம் என்ற பேச்சும் இருக்கிறது. இதுபற்றி தேர்தல் கமிஷனிடம் காங்கிரஸ் புகார் கொடுத் துள்ளது. இதற்கு விளக் கம் கேட்டு வருண்காந் திக்கு தேர்தல் கமிஷன் நோட்டீசு அனுப்பி இருக் கிறது. வருண்காந்தி பேச் சுக்கு காங்கிரஸ் செய்தித் தொடர்பாளர் அபிஷேக் சிங்வி கண்டனம் தெரி வித்து உள்ளார். பாரதீய ஜனதா கட்சி யில் அவர் இருப்பதால் அந்த கட்சியின் கொள் கைகளை அவர் கூறி இருக்கிறார் என்றார். பாரதீய ஜனதா கட்சியில் உள்ள முஸ்லிம் தலைவ ரான முக்தார் அப்பாஸ் நக்வி கூறும்போது, வருண் காந்தி காங்கிரஸ் குடும் பத்தில் இருந்து வந்தவர் என்பதால் அந்த கட்சி கலாச்சாரத்தை வெளிப் படுத்தி இருக்கிறார். இது பாரதீய ஜனதா கொள்கை அல்ல என்றார். பாரதீய ஜனதாவில் உள்ள இன்னொரு முஸ் லிம் தலைவரான ஷான வாசும் கண்டனம் தெரி வித்து உள்ளார். இந்த பேச்சு உத்தரப்பிரதேசத் தில் கொந்தளிப்பான நிலையை உருவாக்கி உள் ளது. ஆனால் வருண் காந்தி நான் இப்படி பேச வில்லை. என் பேச்சை திருத்தி மோசடி செய்து சி.டி.யாக தயாரித்து உள் ளனர். இதுபற்றி நாளை டெல்லியில் விளக்கம் அளிக்கப் போகிறேன் என்றார். வருண்காந்தி பேச்சு பாரதீய ஜனதாவுக்கு தலைவலியை ஏற்படுத்தி உள்ளது. எனவே கட்சி வேட்பாளர்கள் அனை வரும் பிரச்சாரத்தில் மோச மான வார்த்தைகளை பயன்படுத்த கூடாது என்று பாரதீய ஜனதா கட்டளையிட்டு உள்ள தாம். வருண்காந்தியைக் கைது செய்ய நடவ டிக்கை எடுக்கப்படுகிறது.

H eads roll in Uttar Pradesh after the Varun Gandhi hate-speech in Pilibhit. But it’s not the BJP, it’s the state Chief Minister Mayawati who is taking action.

After an enquiry by the DGP and the state Home Secretary, she has ordered the suspension of the Pilibhit Assistant Superintendent of Police, the Sub district magistrate and the SO of Barkheda.

The Election Commission had also ordered the suspension of ASP and SDM, as well as the transfer of the DM and SSP.

Varun Gandhi in a presser said that the anti-Muslim speech was doctored, but at the same time, he defended his Hindutva agenda.

NEW DELHI: A day after an FIR was filed against BJP candidate from Pilibhit (UP) Varun Gandhi for his inflammatory remarks with communal overtones, Gandhi today said that a big political conspiracy was behind the controversy and the CD showing his alleged anti-Muslim tirade had been doctored.

Referring to the CD which has video footage of his communal speech, Gandhi said, “I’ve been a victim of political conspiracy. This is a vigorous attempt to malign my faith…Those are not my words, this is not my voice.”

“The CD has been doctored,” he claimed.

TV reports quoting UP police sources, however, say the CD is authentic and the voice belongs to Varun Gandhi.

While addressing an election meeting in Pilibhit from where he is being fielded, Varun Gandhi had said, “This is not a ‘Hand’ (Congress symbol), it is the power of the ‘Lotus’ (BJP symbol). It will cut the head of ……. Jai Shri Ram.”

Continuing in the same vein, he told another meeting “If anyone raises a finger towards Hindus or if someone thinks that Hindus are weak and leaderless, if someone thinks that these leaders lick our boots for votes, if anyone raises a finger towards Hindus, then I swear on Gita that I will cut that hand.”

Today, while addressing the media, he said, “I am a Gandhi, a Hindu and an Indian in equal measure,”

He went on to add, “I have not made any communal statement…I want the people to stand by me. It is a malicious attempt to brand me communal. There is no question of my having any ill feeling towards (any) community,” he said.

“My attempt is to instill confidence in a community which feels it is under siege in their own country.”

Sticking to the saffron party’s roots, the son of late Sanjay Gandhi and BJP leader Maneka Gandhi asserted “I am a proud Hindu…I’m proud of my faith, not apologetic about it,”

Thousands of people from the Hindu community had been arrested under the National Security Act, temples had been vandalised and village pradhans threatened daily, the scion of the estranged Gandhi family said and claimed his effort was “to restore confidence in the community”.

Pilibhit, he said, was a sensitive border area and there was the widespread fear that arms had been smuggled in.

Declaring that India was “a big country with a big heart”, he said the CD was supposed to have been based on a speech given on March 4 but released on March 16.

The Election Commission on Tuesday asked its UP chief electoral officer Anuj Bishnoi to file an FIR against Varun under sections 153A (inciting communal hatred) and 188 (unlawful assembly) of the Indian Penal Code and section 125 of the Representative of People’s Act.

Soon after, station officer of Barkhera in Lakhimpur district registered an FIR against the young leader who is standing from a seat nurtured by his mother. EC has separately issued notice to Varun and BJP, transferred two officials and suspended another two. The charge of inciting enmity between communities can result in three years in jail — a sentence of two years can bar a person from contesting polls.

This is the third FIR against Varun in the constituency that Maneka has vacated for him after deciding to move to neighbouring Aonla.

In a prime time discussion with Rajdeep Sardesai on CNN-IBN on 17th
March at 9 pm show veteran journalist and columnist Tarun Vijay said
that Varun Gandhi hasn’t spoken against any community. Pilibhit is run
under a complete Islamic dispensation with the District Magistrate,
Additional D.M., Sub Divisional Magistrate- all Muslims posted there.
Its represented by three MLAs and all of them are Muslims. In the last
couple of months five hundred cows were slaughtered by Muslims and
reported to administration through Maneka Gandhi’s office. Nothing
happened. Kidnappings and rapes of Hindu girls is a matter of
routine.

Its a border area , neighbouring Nepal and hence all sorts of criminal
activities goes on. So in this situation Varun Gandhi only tried to
infuse some confidence and assure them that they are not alone. Varun
only sworn on Gita as a Hindu. Any one, including me would do that-if
someone attacks my sister or mother , I would say-I shall not spare

मुम्बई। शिवसेना प्रमुख बाल ठाकरे ने भारतीय जनता पार्टी (भाजपा) के पीलीभीत से चुनावी उम्मीदवार वरुण गांधी के कथित भड़काऊ भाषण से उठे विवाद पर उनका समर्थन किया है। बाल ठाकरे ने कहा है कि ‘यह गांधी हमें चलेगा’।

वरुण गांधी के भाषण पर ठाकरे ने उनकी पीठ ठोंकते हुए अपनी पार्टी के मुखपत्र ‘सामना’ में लिखे संपादकीय में कहा है कि “ये गांधी हमें चलेगा। इस गांधी से ठाकरे को प्यार हो गया है”।

माफी मांगने का सवाल ही नहीं: वरुण गांधी

ठाकरे ने कहा है कि वरुण गांधी ने उन्हें संजय गांधी की याद दिला दी और वरुण के मुंह से संजय गांधी का पुनर्जन्म हुआ है।

हालांकि वरुण की तारीफ करते-करते ठाकरे मेनका गांधी की आलोचना करने से नहीं चूके।

बाल ठाकरे ने मेनका गांधी पर निशाना साधते हुए कहा कि मेनका ने अपनी सारी उम्र कुत्ते-बिल्ली और सर्कस के जानवरों को समर्पित कर दी, पर वरुण में अपने पिता संजय गांधी के गुण हैं।

वरुण गांधी ने बेहद भड़काऊ भाषण दिया

बाल ठाकरे ने कहा, “गांधी-नेहरू वंश का ये कुलदीपक हिन्दू हित की भाषा बोल रहा है”।

बाल ठाकरे अपने लेख में मीडिया की आलोचना करने से भी नहीं चूके और कहा कि वरुण गांधी ने जहर नहीं उगला। वरुण ने हिन्दू जनमानस में दहक रही आग उगली है। वरूण के मन में हिन्दुत्व की आग है, ये गांधी औरों से अलग है।

वरुण से भाजपा नाराज, वरुण बयान से पलटे

गौरतलब है कि वरुण गांधी ने गत 6 मार्च को एक चुनावी सभा को संबोधित करते हुए कहा था, “अगर कोई हिंदुओं की तरफ उंगली उठाएगा या समझेगा कि हिंदू कमजोर हैं और उनका कोई नेता नहीं है, अगर कोई सोचता है कि ये नेता वोटों के लिए हमारे जूते चाटेंगे, तो मैं गीता की कसम खाकर कहता हूं कि मैं उस हाथ को काट डालूंगा”।

वरुण गांधी ने देश के राष्ट्रपिता महात्मा गांधी को भी नहीं बख्शा। उन्होंने कहा, “गांधीजी कहा करते थे कि कोई एक गाल पर थप्पड़ मारे तो उसके सामने दूसरा गाल कर दो ताकि वह इस गाल पर भी थप्पड़ मार सके। यह क्या है। अगर आपको कोई एक थप्पड़ मारे तो आप उसका हाथ काट डालिए कि आगे से वह आपको थप्पड़ नहीं मार सके”।

इसके बाद वरुण के खिलाफ चुनाव आयोग के निर्देश पर स्थानीय प्रशासन ने पुलिस में आपराधिक मामला दर्ज करवाया है। साथ-साथ जन प्रतिनिधित्व कानून के तहत भी मामला दर्ज किया गया है।

Pilibhit/New Delhi: Cracking the whip, the Election Commission on Tuesday moved against Varun Gandhi, BJP candidate and a member of the Gandhi-Nehru family, for his anti-Muslim speeches and police quickly filed a case against him.

As his remarks triggered a political storm and came under attack from within the party and allies, the three-member Commission met and considered the speeches made by Gandhi in Pilibhit in which he had, among other things, threatened to cut the hands of those who would raise their hands against Hindus.

In a slew of decisions, the EC directed the Uttar Pradesh Chief Electoral Officer to file a case against Indian Penal Code and Representation of the People Act against Gandhi and issued a notice to him for violation of Model Code of Conduct.

BJP was also slapped with a notice over Gandhi’s remarks.

Shortly later, the Station Officer of Barkhera filed a case against Gandhi under provisions of IPC and RPA relating to speeches intended to cause enmity among people on religious grounds.

The provisions speak of punishment of imprisonment up to three years.

Under the law, a person convicted of an offence with imprisonment of not less than two years, could be barred from contesting elections.

The Commission also ordered transfer of district officials and suspended two others for dereliction of duty.

The Commission sought an explanation from Gandhi, who is making his electoral debut from Pilibhit, for alleged violation of Model Code of Conduct.

The Commission’s action also came on a day when a Congress delegation met the EC to complain Gandhi’s speech, calling it “highly deplorable” deserving proper action.

Gandhi, whose mother Maneka Gandhi is a BJP MP, also faced strong criticism from within the party.

Senior leader Shanawaz Hussain termed the remarks “shocking” and demanded an unconditional apology from him.

Another leader Mukhtar Abbas Naqvi also assailed the remarks saying they are a manifestation of his family’s past Congress culture.

Rattled by the controversy, the BJP itself asked its party candidates to observe caution and restraint in their speeches.

“We do not subscribe to such views,” party spokesperson Siddarth Nath Singh said.

Party Vice President M Venkaiah Naidu, however, ruled out any action against Gandhi, saying he is campaigning for the party and he is a party candidate.

“What he has said in his speeches is being looked into by the EC,” he said.

Gandhi’s offensive remarks also came under the scanner at a meeting of the BJP’s Central Election Committee where Muslim leaders voiced concern.

Under attack, Gandhi on Tuesday claimed that the CD containing his speech has been tampered with.

“I know it has been (tampered with)” when reporters asked him whether the video footage of his speeches has been tampered with.

“All I want to say is that tomorrow I will be addressing a press conference in Delhi and I will be clarifying my stand on every single issue… I will be addressing from a proper party forum,” the young scion of the

Gandhi family said.
